General Terms and Conditions (GTC) for orders placed via bandfactory.eu
Last updated: September 2026

This English version is a translation provided for your convenience. In case of any discrepancy, the German version shall prevail.

Section 1 Scope and provider

(1) These GTC apply to all orders placed via the online shop bandfactory.eu operated by E-Commerce Istvan Sahin, owner Istvan Sahin, Tuttlinger Str. 28 UG, 70619 Stuttgart, Germany (hereinafter “we”). Contact: support@bandfactory.eu, phone: +49 711 25284541.

(2) The offer is aimed equally at consumers and businesses. A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity (Section 13 of the German Civil Code, BGB).

(3) We deliver exclusively to member states of the European Union.

Section 2 Subject matter of the contract: custom-made goods

(1) The subject matter of the contract is silicone wristbands that are custom-made according to the customer’s specifications (colour, size, finish, text, motif or logo). The design is created by the customer in the online configurator or agreed individually.

(2) The customer is responsible for the content and accuracy of the design data they submit (texts, logos, motifs). The customer warrants that they hold the necessary rights to the submitted content and that it does not infringe any third-party rights (in particular trademark rights, copyrights and personality rights) and does not constitute unlawful content. The customer shall indemnify us against corresponding third-party claims unless the customer is not responsible for the infringement.

(3) We are entitled to refuse to carry out orders with unlawful, discriminatory or violence-glorifying content.

Section 3 Conclusion of the contract

(1) The presentation of the products in the online shop does not constitute a legally binding offer but an invitation to place an order.

(2) By submitting the order via the button “Order with obligation to pay” (in the German version of the shop: “zahlungspflichtig bestellen”), the customer makes a binding offer to conclude a purchase contract. Before submitting, the customer can review and correct their entries at any time using the usual browser and form functions.

(3) Receipt of the order is confirmed immediately by email (order receipt confirmation); this does not yet constitute acceptance. The contract is concluded when we accept the order by a separate order confirmation by email or begin to carry it out, but at the latest when the goods are dispatched.

(4) For order quantities of 9,999 pieces or more, the contract is concluded exclusively upon individual request and after confirmation by both parties.

(5) The contract language is German. We store the text of the contract; the order data and these GTC are sent to the customer by email.

Section 4 Prices, shipping costs and import charges

(1) All prices are total prices in euros. They include standard shipping within the EU and – subject to paragraph 2 – the statutory value added tax applicable in the country of delivery.

(2) For deliveries to an EU member state other than Germany with a value of goods of more than €150 (net), the goods are delivered from a third country without value added tax; the customer is the importer of the goods. The charges arising on import (customs duty and import VAT) and a clearance fee charged by the shipping service provider are shown separately in the shopping cart before the order is placed, paid together with the purchase price and paid by us in the name and for the account of the customer.

(3) For deliveries under paragraph 2, the customer instructs and authorises us and the shipping service provider commissioned by us to declare the goods for customs in the customer’s name and for the customer’s account (direct representation pursuant to Art. 18 of the Union Customs Code) and to pay the import charges on the customer’s behalf. The information required for this (name, delivery address, telephone number and, where applicable, tax or EORI number) is transmitted to the shipping service provider and the competent customs authorities.

(4) The goods are delivered duty paid. The customer does not have to pay any further customs duties, taxes or fees on delivery.

(5) Volume pricing and surcharges for finishes are set out in the current price overview in the shop and are shown in full in the configurator before the order is placed.

Section 5 Payment

(1) Payment in the online shop is made via PayPal. Depending on availability, payment by credit card and other payment methods offered by PayPal are also available via PayPal. The payment methods available in each individual case are displayed in the ordering process before the order is placed.

(2) Upon request, we additionally offer businesses within the meaning of Section 14 BGB payment in advance (bank transfer). This option cannot be selected in the ordering process and requires a separate agreement in text form. In this case we will provide our bank details in the order confirmation; the invoice amount is to be transferred within 7 days. Production begins once payment has been received.

Section 6 Delivery and delivery time

(1) The delivery time is approx. 3–4 weeks from conclusion of the contract, or from receipt of payment in the case of payment in advance. It covers custom production and shipping.

(2) Upon request, express processing is possible for urgent deadlines; we will confirm feasibility, deadline and any additional costs in a binding manner before the order is placed.

(3) The goods are shipped directly from the production facility to the delivery address provided by the customer.

(4) For consumers, the risk of accidental loss and accidental deterioration of the goods only passes to the customer upon handover.

(5) Events of force majeure that make delivery significantly more difficult or impossible for us extend the delivery time by the duration of the hindrance plus a reasonable start-up period. These include in particular natural disasters, epidemics and pandemics together with official measures, war, riots, terrorist attacks, lawful industrial action, energy and raw material shortages and operational, transport or customs disruptions for which we are not responsible — in each case also if they occur at our manufacturer or our shipping service provider.

(6) We will inform the customer without delay of the beginning and expected duration of a hindrance under paragraph 5. If a hindrance for which neither party is responsible lasts longer than eight weeks, both parties are entitled to withdraw from the contract; in this case we will refund any payments already made without delay and in full. If the delay is wholly or partly due to circumstances for which the customer is responsible, the customer has no right of withdrawal under this paragraph. Claims for damages due to the delay do not exist insofar as we are not responsible for the hindrance; Section 10 remains unaffected.

(7) If a print proof for production approval has been agreed, we will send it by email. The customer checks the proof and gives approval within three working days of receipt. If the customer does not respond within this period, approval is deemed to have been given and we will produce according to the proof sent; we expressly point out this consequence of their silence in the email containing the print proof. The delivery time under paragraph 1 begins with the approval.

(8) Delays for which the customer is responsible — in particular an incomplete or incorrect delivery address, approval that is not given or given late, lack of cooperation or refusal to accept the goods — extend the delivery time accordingly. The claim to the purchase price remains in these cases. The customer bears the resulting additional costs, in particular for a further delivery attempt or reshipment, insofar as the customer is responsible for the delay; the customer remains free to prove lower costs.

Section 7 No right of withdrawal for custom-made goods; cancellation

(1) All wristbands offered in our shop are manufactured to customer specifications and are clearly tailored to the customer’s personal needs (individual colours, texts, logos, motifs).

(2) Under Section 312g (2) No. 1 BGB there is therefore no right of withdrawal. We point this out separately in the ordering process before the order is placed.

(3) The statutory warranty rights (Section 8) remain unaffected.

(4) Cancellation: the bands are made exclusively according to the customer’s specifications and cannot be used otherwise. If the customer cancels the order after conclusion of the contract, the customer therefore remains obliged to pay the full price; only the expenses we actually save as a result of the cancellation are to be deducted. Once production has started, there are no more saved expenses, as the goods have already been personalised. The customer remains free to prove that we have suffered no damage or less damage. A cancellation must be sent in text form to support@bandfactory.eu.

Section 8 Warranty

(1) The statutory warranty rules apply.

(2) Minor, production-related and customary deviations — in particular slight colour deviations compared with the on-screen display and small dimensional tolerances — do not constitute a defect insofar as they are reasonable for the customer.

(3) Please send complaints with your order number and photos to support@bandfactory.eu.

Section 9 Retention of title

The goods remain our property until paid for in full.

Section 10 Liability

(1) We are liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, in the case of fraudulent concealment of a defect, to the extent of any guarantee we have assumed and under the German Product Liability Act.

(2) In the case of simple negligence, we are only liable for the breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the customer may regularly rely), limited to the foreseeable damage typical for the contract.

(3) Otherwise, liability is excluded. The above limitations apply to claims on whatever legal grounds, in particular for default, impossibility, breach of pre-contractual obligations and tort.

(4) Paragraphs 1 to 3 apply accordingly to the personal liability of our legal representatives, employees and vicarious agents.

Section 11 Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the German Consumer Dispute Resolution Act (VSBG). We endeavour to resolve any disagreements directly with you — write to support@bandfactory.eu.

Section 12 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.

(2) Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected; the invalid provision shall be replaced by the statutory provisions.
